Intellectual Property Rights

Introduction

This text governs the intellectual and industrial property rights of Blesyum Yazılım ve Teknoloji Ltd. Şti. (the "Company") in respect of the website at www.bimarka.com (the "Website") and its brand, together with the permissions and prohibitions relating to the use of those rights. The rights are protected by Turkish Law No. 5846 on Intellectual and Artistic Works ("FSEK"), Industrial Property Law No. 6769 ("SMK") and the relevant international conventions.

1. Ownership of Rights

  • All content on the Website — including texts, images, graphics, logos, videos, design, page layout, software and source code — belongs to the Company or is used under licences obtained from the rights holders.

  • The Bi Marka / bimarka.com designation and the related logos are trade marks of the Company. Blesyum Yazılım ve Teknoloji Ltd. Şti. is the Company's registered trade name.

  • Third-party trade marks, logos and content on the Website (including client references) belong to their respective rights holders and are used solely for promotional purposes, without any claim of ownership.

2. Permitted Use

You may view the content of the Website solely for personal, non-commercial information purposes. Under Article 35 of the FSEK, short quotations may be made provided that the source (www.bimarka.com) is clearly indicated and the quotation does not exceed the extent justified by its purpose. You may link to the Website in a lawful and non-misleading manner.

3. Prohibited Uses

The following are prohibited without the Company's prior written consent:

  • Copying, reproducing, publishing, distributing, adapting or commercially exploiting the content in whole or in part

  • Using the Company's trade marks in any product, service, domain name, social media account or advertisement, or using confusingly similar signs

  • Systematically harvesting the content using automated tools (scraping, crawling) or using it to train artificial intelligence models

  • Reverse engineering, copying or creating derivative works from the source code

  • Using the content in contexts that disparage or mislead about the Company or third parties, or that are otherwise unlawful

4. Intellectual Property in Client Work

  • Rights in the methods, processes, know-how, templates, tools and software used or developed by the Company while providing services remain with the Company.

  • Economic rights in work products created exclusively for a client are transferred or licensed to that client subject to payment in full, limited to the scope, duration and media set out in the contract between the parties. Under the FSEK, transfers of economic rights are valid only by written contract; rights not enumerated in the contract are deemed not to have been transferred.

  • The author's moral rights are reserved. Unless the client objects in writing, the Company may display the work it has produced as a reference in its portfolio and promotional material.

  • Third-party licensed materials (stock imagery, fonts, music, software libraries) are subject to their own licence terms; liability arising from use outside the scope of those licences rests with the user.

5. Remedies in Case of Infringement

In the event of infringement of its intellectual property rights, the Company reserves the right to pursue all legal remedies, including the determination, prevention and removal of the infringement, pecuniary and non-pecuniary damages, a claim of up to three times the market value under Article 68 of the FSEK, interim injunctions, seizure and the application of the relevant criminal provisions, pursuant to Articles 66 et seq. of the FSEK and Articles 149 et seq. of the SMK.

6. Reporting an Infringement

If you believe that content on the Website infringes your rights, you may notify hello@bimarka.com, providing documents evidencing your ownership, the address (URL) of the content concerned and your contact details. Notifications are reviewed promptly; where a request is found justified, the content is removed or access to it is blocked.

7. Governing Law

Disputes arising from this text are governed by the laws of the Republic of Türkiye; the Istanbul Anatolian Courts and Enforcement Offices (including the specialised intellectual and industrial property courts) have jurisdiction.
