Notice and Explicit Consent

Introduction

This text has been prepared to inform data subjects who complete the contact, quote and career forms on the website at www.bimarka.com (the "Website") operated by Blesyum Yazılım ve Teknoloji Ltd. Şti. (the "Company"), who subscribe to the newsletter, or who contact the Company through another channel, and — where necessary — to obtain their explicit consent under Turkish Law No. 6698 on the Protection of Personal Data ("KVKK").

1. Data Processed Through Forms

Through the forms on the Website we process your full name, e-mail address, telephone number, brand/company name and the information you enter in the message field. The quote form additionally processes the service you are interested in, your budget range and your preferred start time; career applications additionally process your CV and professional experience.

2. Processing That Does Not Require Explicit Consent

The following processing activities are carried out without your explicit consent under Article 5/2 of the KVKK:

• Responding to your enquiry and contacting you (taking steps towards concluding a contract)

• Preparing quotes and running contract processes

• Fulfilling legal obligations and retaining records as evidence

• Securing the Website (transaction security logs)

3. Processing Based on Your Explicit Consent

The following activities are carried out only where you have given explicit consent:

• Commercial electronic messages: Sending promotional messages, campaigns and newsletters by e-mail, SMS or telephone. The scope is governed by the Commercial Electronic Message Consent.

• Marketing analysis: Processing your contact and usage data to analyse preferences and trends and to present personalised content

• Transfer abroad: Where based on explicit consent, transferring data to service provider tools originating abroad (e.g. e-mail and communication infrastructure)

• Talent pool: Retaining your job application for future positions after the position you applied for has been filled

4. Declaration of Consent

By ticking the consent box on a form on the Website, or by making a separate declaration to that effect, you confirm that:

• you have read and understood this text and the Data Protection Notice;

• you permit your personal data to be processed and transferred to the parties stated, within the scope of the activities listed under "Processing Based on Your Explicit Consent" above; and

• you are aware that you may withdraw your consent at any time without giving any reason.

This declaration is deemed to be given freely and on an informed basis.

5. Withdrawing Consent

You may withdraw your explicit consent at any time by notifying hello@bimarka.com. For commercial electronic messages you may also use the unsubscribe link included in every message.

Withdrawal of consent does not affect the lawfulness of processing carried out up to the moment of withdrawal; consent-based processing is stopped without delay once the withdrawal notice reaches us.

You can find your rights under Article 11 of the KVKK and the application procedure in the Data Protection Notice. For data processed through cookies, the Cookie Policy also applies.
