Cancellation and Refund Policy

Introduction

This Policy governs the cancellation, withdrawal and refund processes for the services provided by Blesyum Yazılım ve Teknoloji Ltd. Şti. (the "Company"). It applies together with the General Terms of Service Agreement and the Distance Service Sales Agreement.

The Company's obligations are in the nature of services; as there is no sale of physical products and no shipping process, "product returns" fall outside the scope of this Policy.

1. Cancellation and Withdrawal Notice

All cancellation, withdrawal and refund requests must be sent in writing to hello@bimarka.com together with the order or quote details. Requests made by telephone are not processed unless confirmed by e-mail. The date the request reaches us is used to calculate the periods.

2. Right of Withdrawal for Consumers

Buyers who qualify as consumers have the right to withdraw without reason within 14 days of the conclusion of the contract. However, under Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in the following cases:

• services whose performance has begun with the buyer's approval

• services that are performed instantly

• work prepared specifically for the buyer (strategy documents, design, content production, etc.)

For periodic services whose performance has begun, withdrawal takes effect only for the period not yet performed.

3. Cancellation Before the Service Starts

If performance of the service has not yet begun, the amount paid is refunded in full after deducting any irrevocable commitments given to third parties (reserved media budget, purchased licences, etc.).

4. Cancellation After the Service Starts

• Where cancellation occurs during a period in which performance has begun, the fee for the part performed up to the cancellation date and the irrecoverable costs incurred for that period (third-party spend, allocated team time, production work already started) are set off; the remaining amount is refunded.

• In monthly and periodic engagements, cancellation is subject to the termination notice periods in the General Terms of Service Agreement; the fee for the period within the notice period accrues.

• No refund is made for completed and delivered work or for services performed in respect of a period already started.

5. Cancellation by the Company

Where the service cannot be performed at all for reasons attributable to the Company, the amount corresponding to the unperformed part is refunded without deduction. In cases of force majeure, the parties shall agree in good faith on the refund of the amount after deducting the part performed.

Consequences arising from the decisions and outages of third-party platforms (advertising networks, social media, search engines) are not deemed cancellation by the Company.

6. Refund Period and Method

Approved refunds are made within 14 days of notification of the refund decision, using the original payment method (to the notified IBAN in the case of bank transfer/EFT). The Company is not responsible for delays caused by banks. No interest accrues on the refunded amount.

The invoice correction relating to the refunded amount (refund invoice or expense voucher) is issued in accordance with the legislation; the Buyer is obliged to provide the necessary documents.

7. Items Outside the Scope of Refunds

• Amounts paid to third parties that cannot be recovered (media/advertising spend, domain names, licences, stock content fees)

• Services performed and work products delivered

• Delays and costs arising from the Buyer's fault or failure to fulfil its obligations

8. Disputes

In disputes concerning refund requests, the Consumer Arbitration Committees and Consumer Courts have jurisdiction for buyers who qualify as consumers, and the Istanbul Anatolian Courts and Enforcement Offices for other buyers.
